Bautista said Gunn had already turned in the script for Guardians of the Galaxy: Volume 3. A replacement director for the film, due to shoot early next year, has not yet been announced.
“Where I’m at right now is that if [Marvel] don’t use that script, then I’m going to ask them to release me from my contract, cut me out or recast me.”
Dave Bautista will ask to be cut from ‘Guardians of the Galaxy Vol. 3’ if James Gunn’s script isn’t used

I’m sure they will use the same script to an extent

That’s really idiotic. If they even let him out of his contract, he’d most likely be losing alot of money.

I bet they will use his script but do changes like with what happened with Mr. Snyders Justice League movie. So technically he won’t get cut.

He can ask, but that doesn’t mean he’ll get his wish come true.
